Guarantor & Borrower Advice

Independent Legal is a Perth legal practice that provides independent legal advice and solicitor certificates for guarantors and borrowers, as required by many banks and other lenders.

If you are considering "going guarantor" for someone else's loan or mortgage, the bank or other lender will usually require you to obtain independent legal advice. This ensures that you have the guarantee properly explained so that you are fully aware of the implications and risks associated with signing the guarantee.

At a meeting we will explain all relevant aspects of the guarantee and any associated mortgage to you. If you are happy to proceed with the guarantee, we will then witness your signature of all relevant bank documents - this will usually include a Guarantee & Indemnity; a Mortgage; and a Statutory Declaration. We will also provide a Solicitor's Certificate if required by the bank.

We can advise on all categories of guarantees including:

  • Parents guaranteeing loans to their adult children or their adult child's business;
  • Spouses guaranteeing loans to their partner in relation to an investment property or their partner's business; and
  • Company directors and/or Trustees providing personal guarantees for company, trust or self-managed superannuation fund (SMSF) borrowings.

Our office is centrally located at Suite 8, 224 Carr Place, Leederville, Western Australia (see map, below). For clients travelling by train, our office is a short 5 minute walk from Leederville Train Station.

We offer very competitive fixed rates and fast turnaround - in most cases we will have appointments available within 24 hours and often the same day. Consultations are also available after hours and on Saturdays (subject to availability and additional charges).

Regional and Remote/FIFO Clients

If you require guarantor or borrower legal advice but are situated outside Greater Perth, we may be able to advise you remotely via video conference. All you need is access to a video-calling app such as WhatsApp, Zoom or Skype on your computer, tablet or smartphone. Note however that not all banks and lenders will allow remote advice, so please check with your banker or finance broker first.
